Additionally, if the whois service (crsNIC or the "losing" registrar) is
down, we have administrators who manually can grab the addresses when the
whois service is restored at the offending party.
And if we're not going to rely on whois - how do you propose we gain proof
of ownership to approve the transfer? The onus is on us as 'gaining'
registrar to provide such proofs if ever there was an inquiry...
