The registration fee is non-refundable (for the domain) The respondant is
also required to pay the $295 WIPO arbitration fee. Whoever the successful
party is, the arbitration fee is refunded (with the exception of a $75
non-refundable fee)
If the challenger wins the case, and have legitimate trademark rights, then
they are awarded the domain - if the challenger does not have legit rights
to the name it is entered back into the eligible pool of names for
distribution after the end of the sunrise challenge period. (December 2001)
If a challenger is successful, they will be required to register the domain
in question through a registrar (at the 5 year sunrise term). There was no
mention of refund for the respondant (initial registrant) that I could find,
so this tells me that there is no refund to the initial registrant.
