Hi Michael, I've jumped in at the end here but have a thought. Are you sure this was deleted, transitioned, and registered? You can tell something from the creation date. If it has the ORIGINAL creation date this domain was NEVER deleted. If it doesn't, you can't tell (a domain gets a new creation date during a transfer).
The reason this is important is that domains can be hijacked by fax -- essentially by wire fraud. If this looks likely, give me a shout and I'll suggest more. I'm unclear about the trademark issue - from what I can tell, it may be common law only but we'll be talking to their lawyers soon and hopefully we can clear this up. They're not opposed to paying the UDRP fees - I'm the one who thinks it's punishing the complaintant more than the respondant.
