This is entirely dependent on the explicit agreement that you have with your
customers. The best way to cover all bases for all TLDs is to ensure that
your user agreement specifically states that the user must give up certain
rights in exchange for other considerations. A lawyer type will definitely
be of help in determining what the give and take's must be in order to
ensure compliance with the various registry requirements.

Keep in mind that the legal creativity required is about equal to the
technical creativity required - it's not that this is a lot of work, but you
will need to know what you are doing (or have the assistance of someone that
does).
