This will inevitably thread drift into its own line of comments, but
we can second-guess this thing to the moon.

Bottom line is, the EU can go ahead and proceed, it will be moot if
ICANN doesn't update the root servers, period. Corrupt or not, that's
the reality.

Although thinking about it, the alternative scenarios are endless:
the EU creates their own root and legislates their ISP's and telecoms
into using it, leading to a split  in the namespace, APNIC gets sick of
waiting for ICANN and follows suit, forming their own  Unicode UTF8 root,
and we wind up a triple-faulted namespace.

...which may not be the end of the world. The ensuing chaos would
open up all sorts of business opportunities.
