I have a client who had to register a new domain because of that very issue. The company who registered it on behalf of my client is refusing to allow my client to use it. My client doesn't wish to spend the legal fees to fight the issue when the name is "only worth $15.00". So the other company gets away with it. I checked with dozens of the registrants that they have done that "for" (their words; mine would be "to") and nobody is interested in fighting for the ownership of their names.
