Frankly I don't really understand how useful it is right now, regardless
of where it appears in relation to the data.

Near the beginning it says "By submitting a WHOIS query, you agree
that..." and then near the end it says "By submitting this query, you
agree to abide by these terms".  Well, uh, the user has already submitted
the query (and received its output), so how can anyone sensibly construe
that the user chose to agree to any terms?

It would be like someone asking me for a bag of chips, and me handing it
to them.  After they have the bag fully in hand, I mention thqat "by
asking me for the bag of chips, you agree to let me kick you in the shins".

Any reasonable person would persecute me if I were to then to kick him in
the shins.
