innerHTML works just fine on XHTML pages - jQuery.com is XHTML.
Additionally, as mentioned before, jQuery doesn't use innerHTML for
insertion - only serialization (even .html()). This way you can even
do:
$(someXMLDoc).append("<foo bar='baz'/>");
