The FSF amicus there is brilliant.  Thanks for 
pointing it out.

There are two main objections to the settlement
that can stand in court, as far as I can tell:

One is that the plaintiff's don't legitimately
represent the class.

The other is that Google is offering to settle over 
ill-gotten gains (e.g., Google has no standing to
negotiate over the database but does have an obligation
to preserve it and hand it over the the court of equity).

The FSF amicus appears to hit the first point solidly.
