The FSF amicus there is brilliant. Thanks for pointing it out. There are two main objections to the settlement that can stand in court, as far as I can tell: One is that the plaintiff's don't legitimately represent the class. The other is that Google is offering to settle over ill-gotten gains (e.g., Google has no standing to negotiate over the database but does have an obligation to preserve it and hand it over the the court of equity).
