It may actually be the case that bloke #1 knew the academic term "community of practice" as it was developed by Lave and Wenger in the late 80s/early 90s (see http://en.wikipedia.org/wiki/ Community_of_practice for what appears to be a decent intro).
He might have been thinking that the openness and volatility of a discussion list fits poorly with the sustained, committed participation and the gradual assimilation that are part of the CoP notion. However, I would argue that a community of practice is not its discussion list. I see no problem with the idea that several communities of practice overlap and share information through an open discussion list.
