Terms of Use interactions have always irked me-- is a checkbox enough for
someone to confirm that they've actually read an understand the terms of
use? Sure, we can get someone to finally check that checkbox by disabling
the "Just buy it, dammit!" button and holding it hostage. The problem with
putting up a message is we're getting in the buyer's way-- she thought she
was about to pull the trigger, which took a lot of decision-making. And now
we're telling her she has to go back and read this lengthy terms of use
statement? "Whatever, I'll just click the checkbox"

So if our goal is to get that pesky checkbox checked, those are two passable
options. But if you're able to talk with the legal team and boil down the
terms of use into an easier, layman-readable bulleted list (with a link to
the legalese for those that are inclined), then maybe it makes sense to
integrate the agreement into the purchase button: "Here's what you're
getting yourself into. Cool? Agree and Purchase."
