I've dealt with the landlords for a while now. While I think it's pretty unfair for them to throw back electrical at us from the day we started, we don't even have a chance to negotiate this anymore since AssentWorks accepted this and already wrote a cheque to cover the amount. I think that given a chance to talk to them, they might've moved on this number a little bit - but I'm not sure. It's all speculation from this point.
My personal opinion is that once this issue is sorted, the landlord will not have anything else to say because we will be covering our costs and covering their costs. This is really all they're looking for - to not lose money on us. There's never been any mention of trying to "wring us for the max money" - in fact, when you look at what they've demanded in the past, it's been quite reasonable. They asked us to cover our gas. Then they asked us to cover our electrical. They recognised there were public utilities on our panel and offered a $1000 annual credit for this. They even paid to have heating installed in the washrooms and classroom - when really, only the washroom was necessary so the pipes wouldn't freeze. The power wasn't a miscommunication but a stupid mistake on their part. From the start it was their assertion that we use the floor as "office" space; when they saw the AC units, equipment, etc. they couldn't see past this and thought we were running a heavy manufacturing plant up on the third floor. It took a lot of convincing by me and Mike Legary in discussion with the landlords and still they can't see past the big machines and AC units. I'd say Hanlon's Razor holds true in this situation. They were stupid and didn't charge us for electrical and lost money; hence they asked for a new lease; hence they essentially sent the past bills back to us to recoup their costs due to their poor decisions. I honestly think that once this new lease is settled and done with, we won't hear another peep out of them.
