This could more likely fall under regs (in the US anyway) for private, non-revenue producing internet radio which I don't believe are required to pay royalties. Or it could be more like sharing a mix tape, which I believe is covered under Fair Use provisions.

Also consider that the entire structure of SS is geared towards private streaming, not public copying. That the standard recommendation is _not_ to expose the SS port to the Internet. And that these download links are buried on the song info pages that can only be loaded one song at time. It hardly seems like a P2P service.
