Let's be clear on another thing.

Some form of copyright was in the US constitution.

This is what the US constitution says on the matter:

"To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;"

I think current copyright law in fact curtails progress of Science and Art, not promote the progress thereof.

Of course, I don't have enough money to buy laws I would like in Washington.
