The CDDL is license is *not* "closed open source". Please, please please do not mix up the CDDL with the recent anouncement of non-OSI licenses for Java. THOSE were the ones that were labeled "closed open source". Not the CDDL. The CDDL is actually not a bad license at all. And in and on itself it is quite good. It provides a reciprocity similar to the GPL, but takes it a bit further to include software patents. This is very important, and right now the GPL is being updated to account for software patents as well. And you can expect the GPL v3 to have a patent clause very similar to that of the CDDL. That is, "by giving out this code, you give us full rights to use any and all patents that you might have, covering that code". That's a very important clause, in the spirit of the GPL, which has become necessary in recent years.
