Exactly. All the discussions that the EC should have invalidated the
patents are void, because the EC has no control whatsoever over the EPO.

That's a strange view - there are a lot of organisations that the EC has
no influence upon (and IMHO it has to be that way in a democracy).

That there is *no* other institution that controls and influences the
EPO in a democratic way is a severe bug in the system, but you can't
blame the EC for that.
