Its the second option. If the setting is enabled FortiMail doesn't do a DMARC check on domains that have no DMARC record published. But if a domain has a DMARC record and the email fails DMARC check, the action is taken no matter what policy is set in the DMARC record.
That a p=none record have the same impact as no record is an important property, as the ability to turn on p=none without impact is an important enabler for domain owner/registrants to explore implementation. If FortiMail is implementing feature that breaks this property then it would be worth addressing (sadly, I have no relevant contacts).
Exactly this. The problem is their engineering team thinks that this is a valid implementation.
