Only if you ask a recursive query. If you ask a non recursive query you get a referral. What we should be asking is why are we allowing delegations to be made to nameservers that are not configured to serve the delegated zone in the first place. What we should be asking is why delegations aren't regularly being checked for consistancy as required by RFC 1034 and when inconsistancies are found why are they allowed to persist for long periods of time.
