I don't think thats quite a true statement.
For example - I have come up with a business model of 'drunken hoon 
chaffeurs' - the idea is that you can go out for a fun night by paying 
us to have a Drunken Hoon chaffeur you! It'll be a great money spinner 
and really popular!
Whats that you say? Illegal? No, no, Charlie says you can't restrict 
business in any way or form.

OK, so its a silly example and over the top, but clearly business is 
restricted in what it can do.
If the terms of the license they buy to have a domain name say they can 
only do this and that with it, then that is all they may do.
The only question is if the terms are clearly defined, and able to be 
verified in a sensible fashion.
