The Court affirmed the District Court’s ruling that the version "perfumebay" as a conjoined term is confusingly similar to "eBay," but rejected eBay’s contention of infringement against non-conjoined versions of the Defendant’s name in which the two terms are merely separated by a space – like "Perfume Bay."
