well again i dont 100% follow you here. 
if by in-document you mean: all these pages belongs to
"about", and all these pages belongs to "download" etc then
i can understand you to some degree.
the idea of this is similar to sites having certain colors
or looks for a particluar item in their menus, no?
only we use - luckily - the same colors across menu items.
i think that from a webusers point of view it is more
confusing than gaining.
thomas mentioned these top|toc shouldnt be obstrctive and i agree,
but any widget i guess will be a bit obstructive.

i did try an arrow up instead of the word "up". the problem
with arrow up is
that it points up and thus some might think it points to top
of current page.

well i just like the idea of underlining links "out of the
house" (eg http://www.perl.com) to visualize for the users
they are leaving the mod_perl site
maybe we just have to compromise somewhere?
