Hello all
    I view of the recent discoveries that the  email defence data center 
location is moving to a United States based facility I wish to start a  
discussion to hopefully stop or modify this move. I am not at issue with a move 
simple as to where and the fact our clients privacy any confidentiality will 
now be subject to breach.........
The issue is that once this occurs all email that enters  that facility is now 
subject to viewing by the "Inland security agency" which breaches to say at 
minimum several policies of my clients and I'm sure of yours. If your clients 
us the email defense service they instantly become subject to the same rules 
once the data center is located in the continental US.

New data center The new Email Defense platform will be hosted in the Qwest data 
center in Denver Colorado with the recently acquired Hosted Email systems.

    This move has never been announced publicly but was rather "hidden " and 
what I mean by hidden is. ... never publicly discussed or promoted but 
announced on tucows web site and I know of no other place. This is a very large 
very important fact that actually makes "most" of my filtering client leave the 
service due to fact of its physical location in the United States breaches 
there internal policies as I will explain further. 
       This move should be of extreme interest to anyone using the email 
defense service that is not a United States resident. The number of none US 
residents is in all likely hood rather large and I am within that number. 
     I must be clear that I have no issue with the abilities or the facility or 
its methods or staff . My issue and yours should be around its US location and 
now being subject to the US inland security act. The fact that all email is now 
routed into the United States and opened to scan. makes the email subject to 
the "Inland Security Act" and its rules (not pretending to fully understand 
those).
     I will not even start to count the number of ways in which this breaches 
our policies and the policies of our clients and I'm sure yours. These breaches 
in my clients policies immediately makes this service inadequate for their 
needs and they have already told me to find non US based provides or they must 
leave. 
    The clients have a issue and a well researched issue to say the least. We 
have several clients who came to us because our filtering data centers were 
located outside the US. 
I in no way am attempting to upset the apple card but this is a issue that must 
be addresses quickly were aprox. 60 days or so form the move. I have been told 
the location picked due to price well as the new prices for the service is 
dropping roughly 50% that is a invalid point. No matter the cost or lose this 
must occur and quickly.
    With out a change to this data center location I can see a very large out 
fluke of clients as we are now limiting  our ability to offer service to other 
than US based clients. To mention but a few of the organizations that will not 
allow there mail to be opened or scanned in the US and have internal policy to 
such are government(local municipal and federal), education, oil services,  oil 
exploration etc etc. now that is a very large sector of our clientele that is 
now affected. 
    I step back and hope this start the discussion that brings this move to a 
full halt. I have full faith Tucows will step up to this one and make the right 
move for all resellers.......
