We've been doing this for almost a year and a half now but I wouldn't  
say we "claim ownership", rather we register names that have not been  
renewed by the original registrant after the 40 days we allow for  
renewals.  If after 40 days and numerous attempts to get them to  
renew a registrant doesn't renew we assume they don't want it and we  
buy ones we think might have value on the after market.  Others go up  
for auction.

Yes, if we own the domain and you come back to us on the registrant's  
behalf asking to get the name back we provide a "Domain Rescue" for a  
small fee that gets you the name back.  So you are in fact in better  
shape when Tucows buys the name than when the name drops and is  
picked up by someone else where you have no relationship.  It's VERY  
rare these days for names to go back to the registries to be put back  
into the pools.  Almost all domains that expire are now bought by  
SOMEONE.
