I didn't take the time to ask the question on the Debian Live list but I suspect the problem to come from the live build process while making the so-called “initramfs” file. In short when Linux boots, it starts the kernel and uses data in a RAM disk whose disk image is in “initramfs”. When the boot process has finished its early boot operations, it mounts the standard file system and remove the RAM disk. To show the splash screen during early boot, splashy has to put its files in the “initramfs” file. There is a configuration option to do this, but it seems to not be taken into account by the live build scripts. This is why we get error messages. Then the standard (live) file system is mounted and splashy finds its files. Note that the splash image has changed between the build you are testing and the latest builds available today. Tux is the default splash screen of splashy.
