K1MAN is required by US and International regs to check for activity *prior* to transmitting. If he transmits on top of an existing QSO he will be warned by Riley Hollingsworth, then fined, then if he continues will have his equipment confiscated and his license revoked.
The simple solution is to publicize the Net, make sure sufficient KW signals are present to hold the frequency, then document carefully any interference from K1MAN or anyone else.
No-one "owns" any frequency other than first-come first- served. Yielding a frequency to a Net or self-appointed neo-legal broadcaster is a voluntary not mandatory choice by the person or persons first on freq.
I am not suggesting that we go looking for trouble but I strongly dislike anyone broadcasting on a Ham band -- do it properly get a shortwave freq. allotment outside of the Ham bands!
