That would be the best choice.

Second best (sort of a distant second) would be to study the driver, 
write in plain English (or your native tongue) the operation of the 
*device* (not the driver!), then write a new driver without looking at 
the GPL code.  This is tricky, and is best undertaken with separate 
teams -- one that studies the GPL driver and writes the spec, and 
another team that writes the driver.  (This is called a "clean-room 
approach".)
