Hi Humberto,
before you can use your index with Solr 4.4.0 (DSpace 4), you have to upgrade to DSpace 3 and run that version of Solr optimize. Then you can continue to upgrade to DSpace 4.
Step 10 in the upgrading docs describes this:

I'm going to close this issue because it doesn't look like a bug in DSpace. If it doesn't work after you try what I wrote above and you still think it's a bug, write another comment and we could reopen the issue.
