I think we should use HTML5 with fallbacks. G.e. we should think on users using devices like a braille display.
In case of DS-1994 [1] we check if the Browser supports HTML5 File API and HTML5 Drag&Drop. If it does not we fall back on the "old behavior". Checking this with IE 9 I just saw, that the fall back does not work, as it should. I'll fix this as soon as I find some time (probably in 2-3 weeks). While checking the fall back I noticed, that demo.dspace.org/jspui is not usable with IE9 as the drop down menus don't work properly. I remember some discussion on dspace-tech, but was unable to find it. Is there already a ticket or a patch for this?
