This is what a METS file with a CC license file looks like:
http://demo.dspace.org/xmlui/metadata/handle/10673/149/mets.xml

You can try submitting it via SWORD to see if it lands in the correct bundle.

And I'm not sure why Stuart was talking about the rightsMD section,
but here's how to render the METS file with rightsMD:
