As mentioned before, I greatly support the idea to (re?)structure that part. 
However, if I understood correctly, the method effectiveThermalConductivity() 
in your proposal would combine the thermal conductivity of the solid with that 
of the fluids (by accessing saturation), and by that introducing 
model-dependent things into the spatialParameters.
Shouldnt we have the combination of soil thermal conductivity in 
spatialparameters and the combination step (return ldry + sqrt(Sl) * (ldry - 
lsat)) in the model, e.g. flux variables / computeFlux ?
