No idea what's making this happen, Jack - but have you tried holding down option whilst emptying the Trash??
The problem is the files won't go _in_ the trash.

"Empty Trash" in my startup items folder, as sometimes the best way
to empty said trash turns out to be by simply restarting. YMMV, of course.
