I note that Sidd has never specifically denied saving our site to his hard drive and posting it slightly modified to his site. I suspect that's what he did. The answer is: because the Cambist.net site was posted first, as Sidd has admitted publicly, and because the Cambist.net site's copyright went up first. Gold Barter Holdings is vigorously defending its copyright. We made a copyright on our actual page, and posted it first. We haven't patented or copyrighted the idea of automated exchange services. I did not first accuse Sidd of stealing. JP May pointed at Sidd stealing. First JP did so to me and Tristan privately, then publicly on at least one of these lists. Sidd did nothing then. So, I took up the issue with Sidd in a series of politely written private messages to him. Still Sidd did nothing. Contacting him privately proved to be a waste of time. I will agree that Sidd exhibited irritation. I won't agree that he exhibited willingness to discuss the matter politely. Nor do I agree that a discussion was in order. What I asked Sidd to do was stop using Gold Barter Holdings property on Sidd's web site. That isn't a difficult thing to accomplish, as Sidd now admits. And, I'd like to point out, that was my job. As an officer of Gold Barter Holdings, I have a fiduciary responsibility to the owners of Gold Barter to protect the private property of the company. I don't have any choice about it, even if I wanted to let one worthless little thief get away with something he knows he shouldn't have done. I did not copy Sidd's site, I wasn't the first to point out that Sidd had copied Gold Barter's site, and yet I'm supposed to be the bad guy because I've irritated him. Nonsense. All ideas are Sidd's ideas, so everyone is stealing from him. JP claims ownership of the idea behind the Cambist.net site, but, you'll notice that he hasn't had the bad taste to create a duplicate of the HTML code that appears on our site and use it for his own. But, we aren't talking about a stolen idea. We're talking about copyright property that was stolen. > and I don't intend to start now. This rather odd request comes after repeatedly refusing to do the one thing that he still refuses to do: change his web page. Y'all should know that the phrase "non-aggressive" was a tearing point for me. See, stealing is aggression. Asking for the return of one's property is not aggressive. Really, folks, what reply should I have made? I had already asked, in a very non-hostile way, that the page be changed so it doesn't look like the Cambist.net page. I'll be a mean, nasty, brutish person. Thieves deserve ignominy, abuse, opprobrium, public criticism, and to be compelled to pay compensation. I've done worse. I've pulled guns on people I thought were trying to rob me. I am prepared to kill in defense of my property. Everyone should be. Private property is important. Sidd just doesn't seem to get it. > Jim turned down my offer Let's be clear: I had already, repeatedly stated what Sidd should do to satisfy Gold Barter Holdings: make his page look different. (We didn't order him to take down his page, stop his automated exchanges, or appear in court.) He refused, repeatedly, and still refuses, to do the one thing that would fix the problem. At this point, if he were to completely change his page, that would still make the problem go away. But, his persistence beyond this point in time seems clear. One of the interesting things about Sidd is that he doesn't make any offer, then revokes what he claims is an offer. His offer was not to actually do any of the things that had already been requested, even if they were requested of him again. His offer amounted to "go ahead and make a polite request of me." I had already done so. So, revoking his offer to ignore my requests seems pathetic.
