In response to Patrick's attempt to justify his position: GoldNow.com is not a competitor to GoldNow.st. As such, the usage of the GoldNow name is not going to be confusing to customers. While the digital gold industry currently has a much more savvy crowd of consumers, having 'AnyGoldNow' and 'GoldNow' as competitors is blatent copying on one side or the other. Given that I've seen GoldNow for significatly longer, my initial reaction is that 'AnyGoldNow' is copying that name. Furthermore, this copying is a blatent attempt to capitalize on the good and long standing reputation of GoldNow to avoid that time consuming buildup.
Patrick mentioned that he got a registered trademark on 'AnyGoldNow'. I would like to point out that trademarks are as easily overturned by prior art as patents are. Its also important to note that you can get a registered trademark that is blatently overlapping another registered trademark. Trademark registration does not imply a trademark search or any other due process in acquiring that trademark. Bottom line: GoldNow.com does not infringe GoldNow.st as they are in different businesses entirely. The good name of GoldNow.st does not carry over to GoldNow.com, nor is any negative connotation automatically carried over. AnyGoldNow and GoldNow.st are in the same business. As a result, both good and bad carry easily both directions. Given that GoldNow.st has been in business longer (around 2 years, correct Graham?), there is only one conclusion that I, and likely any competant court, could arrive at: 'AnyGoldNow' is attempting to steal the customers of 'GoldNow' by blatently copying their name and promoting themselves in such a way as to provide confusion to the consumers.
