What  else might people do when they miss some procedural requirements for 
manufacturers exchange scheme? 
They throw it on the second hand market and sell it via ebay to people like 
me....

Hm... so you agree that a firmare issue _might_ be a plausible cause?

So I'll google for either a fw upgrade,
 or ebay for a Intel branded card, like the first one I have.

HP ? I can confirm this finding:

        I have checked, NC364T does not have firmware available for download 
        on HP site. That probably means, 
        there is not firmware update available for this NIC.

Same holds true for Intel & 82571EB firmware

I think if it were a common / simple / known issue, this list were the place 
where people knew about it. 
If it rings no bell with nobody, I'II have to change the board.
