But since the book is no longer commercially available, and therefore
the author's estate and publisher will suffer no financial loss, and the
user intends to properly cite the work, isn't a photocopy of the
relevant sections "fair use"?

|I believe it is against the law, regardless of status of authors or
|intended use.  There may be a time limitation on the copyright, but
|suspect that it is more than 10 years.  A google seardh for copyright
|law might yield more specific information.
