Mike, I know you are only the messenger, so please don't take my
comments personally but feel free to communicate them back.
The X12 IPR policy is only directed towards X12 members that make
contributions and has nothing to do with the use of the standard by
anyone. It covers patents that maybe relevant to the standard and the
transfer of any IP (copyright) that a contribution may contain. Mr.
Connors should also be aware that there was time period when X12 had
no IPR policy and therefore early contribution are not retro actively
covered by this policy.
As to the statement that there are "non-members or those who have not
purchased the standards [but] have made profits from the standards," I
would agree that this is a valid assumption. However, there is no
legal requirement for anyone to be a member of X12 and/or have to
purchase the standard to profit from it without the illegal sharing of
copyrighted material. There are a number of ways to legally create the
data tables required by translators from a number of other legal
sources, such as electronic versions of implementation guides. This is
a very slippery slope that X12 and DISA are getting into.
