*The digital revolution and the ongoing upheaval of the public sphere
confront liberal democracies with an urgent challenge: how to legally
regulate freedom of expression to preserve the possibility of democratic
debate? In order to design new regulatory frameworks for new political
forums, such as social networks, it is important to understand the link
between the right to freedom of expression and the political practice of
democratic debate. *

*What are the actors, the forums, and the discourses that make up public
deliberation and how can their free expression be protected? What rights
does freedom of expression include, if it is understood as a political
freedom, whose function is to allow participation in public debate? What
limits can be imposed on this freedom to ensure access to information,
equality of opportunity or pluralism of opinion? What mechanisms can
protect citizens against public and private forms of censorship that
threaten collective deliberation?  These questions have been widely
discussed in the US context, within the perimeter of the First Amendment.
But they have not received the same attention in Europe, where freedom of
expression, democracy and their relationship are conceived in a distinct
way.  *

*This conference brings together European specialists of freedom of
expression – legal scholars and philosophers – from a variety of countries,
as well as judges from the most influential courts on the continent, such
as the European Court of Human Rights and the German Constitutional Court.
It also features renowned scholars of free speech, in particular
specialists on the American First Amendment, to provide a critical
reflection on the European approach as seen from outside Europe.  Its aim
is to provide a comprehensive and critical analysis of the European
understanding of freedom of expression as a democratic right, and of its
actual and potential implications for the legal regulation of public
communication in the current communications environment.*
