The utilities are not the same as the internal radio firmware.
To take your horse breeding analogy, it's like the type of feeder the horses are eating from. They can be metal, or plastic, or rope netting, and it doesn't change how the horse runs.
The radio internals should not be open source. The external utilities are a fair topic for discussion.
