One would like to add that in the case of a problem with Telecom and ITE 
equipment(and probably other products)  the EC is re-focussing upon  an even
older Directive
85/374/EEC ( OJ  L 210  Volume 28 dated 7-8-85)  to which I give the short
title "The product liability Directive".
The intention is to use the National  Laws  introduced by 1988 in all EC
countries to make producers liable for damage caused by defects in his/her
product.  Recommended reading for lawyers and manufacturers.  This is referred
to in  the draft proposals for the yet to be seen CTE Directive.

     Hello Vic,
     
     In the absence of specific European Community provisions governing the 
     safety of a product, the General Product Safety Directive (92/59/EEC) 
     prevails. Your market may already dictate that you have to apply the LVD 
     and hence EN 60950 for ITE. See what the competition is doing. However, to

     play it safe, at least apply the LVD and IEC 950 for the cases below and 
     investigate the safety mechanisms for high voltage. You could apply other 
     standards like IEC 1010-1. However, the bottom line is to always make the 
     product safe. You don't always need a standard to verify this. Using 
     common sense is a good way to accomplish this.

Interesting question came up at the EU seminar yesterday in Toronto, where 
nobody really was able to give a definitive answer.
     
Questions comes in an EU related version and in a general version.
     
What are the regulatory requirements for a device that has a "rated voltage" 
below the limits of the LVD, but has inside voltages that are:
(a) within the scope of the LVD
(b) higher than the scope of the LVD
     
What are the requirements for a device that has a "rated voltage" 
below the limits of IEC-950, bust has inside voltages that are: 
(a) within the scope of IEC-950
(b) higher than the scope of IEC-950
     
We all knew the common-sense answer, but common sense is nothing 
than the sum total of what you've learned before age 18 (I believe).
