Seems to me that the problem has been solved by allowing an
undefined 'professional' category for equipment which then places the
entire obligation on the manufacturer to be prepared to defend his use of
this class for equipment... So, manufacturer beware, if someone can
identify a non-professional or consumer use of your product, your claim of
'professional' use goes out the window... good opportunity for a lot of
lawyers to make a few bucks - no matter which side they work...
