Joe,

One aspect of the Directive that is overlooked is that users have a 
responsibility as well.

Therefore as you identify that your unit is Class A and the user insists on 
using it in a class B environment the reposibility is his.

To date I am not aware of any action being taken against any manufacturer for 
this situation and would suggest that a case against yourselves would fail as 
you have shown the necessary due diligence.
