In order to try to give some answers to your questions, we need to know what
levels of testing you do for EMC, safety (etc.), i.e.: are they: 

a) full standards-compliance tests, in which case the equipment is often
likely to be physically &/or electrically damaged and may well not be
working at the end of the tests.
or 
b) Only visual inspections and/or non-intrusive/non-damaging/non-"abnormals"
tests.

Case a) items would almost certainly NOT be suitable for sale as "new"
items, although when properly electrically and cosmetically "refurbished"
and re-production-tested (inc hipot etc), and then could probably be sold as
Used, Refurbished or "demo" stock (etc), and with full (?) warrantee etc.
However, in such cases, it would be prudent to annotate the production
records with details of the tests performed and the results found, in case
that currently-hidden faults caused by these tests develop at a later stage
to the level of non-compliances.

Case b) items would almost certainly be OK to sell as "new" since these
types of tests are essentially only extended versions of production QA audit
tests, and might well be more reliable in service due to the extended
burn-in period to which they have been subjected. OTOH, some parts of the
equipment may simply be "aged" by such tests and their life-expectency thus
reduced.

So the answer seems to be "it depends", and there is a strong element of
professional judgement and ethics involved :- would you AS A CUSTOMER feel
happy about being sold case a) or case b) equipment without knowing
something of it's history? If not, then don't sell it to someone else, or do
so only with full disclosure!

Subject: New vs. Used Instruments







When we need to do compliance testing on alternate constructions,  we
sometimes have to take a unit out of inventory.

When this instrument is returned to inventory, is it considered new or
used?

Are there any industry or legal standards which differentiates between new
or used instruments?

All opinions on this issue are appreciated.
