MessageI had the same question last year. When you look at the PECAS for the new members, Poland was not listed as having any arrangements in place for the EMC and LVD. Neither did Cypress. I posed this very question to the EU and received this response.
Short answer: as of 1-May-04, CE mark required. Before 1-May-04, only existing law accepted. No transition period where both, national and CE marks are OK. As far as Poland is concerned, the EC Directives 73/23/EEC on low voltage (LVD) and 89/336/EEC on electromagnetic compatibility (EMC) have been transposed into Polish national law by, respectively, the regulation of the Minister of Economy, Labour and Social Policy of 12 March 2003 on essential requirements for electrical equipment (Journal of Laws of 2003, no. 49, item 414) and the regulation of the Minister of Infrastructure of 2 April 2003 on electromagnetic compatibility (Journal of Laws of 2003, no. 90, item 848). Both regulations provide for the use of CE marking to indicate compliance with the essential requirements. However, please note that these regulations only enter into force on the date of accession of the Republic of Poland to the European Union (i.e. 1 May 2004). Until then, products being placed on the Polish market must meet the requirements of the existing Polish legislation in these areas.
