Richard, You ask a question but do not state all the relevant facts. Are we to take it that the equipment is presently outside the boarders of the EU and will be imported into the EU by Company A to be sold either to Company B or some private individual? If the answers to the above questions is YES then it seems logical to me that the answer to your question must be NO. Were this not to be the case then the EU would be flooded with non-compliant products marked "Refurbished". How would any enforcement authority know whether such a product had been truly "refurbished"? Sounds like your "some" have found a lucky star to wish upon - either that or you were asked prior to noon on 1st April: it's well past that here.
