The manufacturer, being the Listee (ie product carrying the company's logo or company name) is the responsible party to identify standards. The manufacturer, can get the help of a third part test lab for guidance, but at the end of the day, the manufacturer (Listee) is responsible. 2. Again, it is the responsibiliy of the manufacturer (Listee). 3. It happens all the time. For example, I know of a case, where a medical manufacturer (Listee) got caught selling their equipment under the LVD/EMC Directives and not declared under the Medical Device Directive. It is so easy today to declare equipment under a different Harmonized customs tariff code to trick the customs inspectors. 4. Regulatory agencies cannot ensure that each and every product meets the directives. However, regulatory authoties (like FCC and customs authorities) can stop shipments of goods worth milllions of dollars for non-compliance. Again, I want to emphasize that is the Listee (company name or logo) which appears in the manuals and product is the responsible party. Whether the Listee understands or does not understand a standard, the Listee is resposnible for the technical content of the files.

Who is responsible for identifying the appropriate EMI / EMC standards for a product to comply with, for placing the product in different countries. Is it the manufacturer of the product or the accredited test lab in which the product final certification testing is being done and the report is being compiled or both? 2. Who is responsible to ensure that the product is complying with all the necessary provisions / sections of a standard. Is it the manufacturer or the test lab or both? 3. What will happen if something is found wrong at a later date, either a wrong standard is followed or the testing is insufficient to prove the compliancy with all the necessary clauses of the specified standards? 4. How the regulatory agencies (FCC / CE etc.) are ensuring that every product that is placed in the market is complying to the necessary clauses of appropriate standards?
