Anders,
  I'll offer the following advice

1.  That's definitely not acceptable.  If you could get away with any software
having this capability, you might be able to do it with test software - but
definitely not with production software.

2.  The type of antenna & gain:  Antennas of the same TYPE with the SAME or
LOWER gain no longer require retesting (as of sometime this year, I think). 
NOTE - this is only for antennas of the same type.  If you go from monopole to
dipole or any other antenna type, you will need to perform permissive change
testing.  But if you go from a 3dBi dipole to a 2dBi dipole, no requirement
for test.  Also, it follows that if you increase the gain of the antenna, you
must re-test & file a permissive change (this hasn't changed).

Dear group,

I hope someone could help me about the following  regulatory questions
regarding a WLAN accesspoint (802.11b and g) for the EU and US/Canada market.

1. Is it permitted to have the power output adjustable by SW settings so you
can exceed the allowed power output if wrong settings are made? The power
settings should only be done by operators not the users.

2. Is it allowed to use any antenna that have the same or less antenna gain
than that we use for our approval test or must always the antenna be certified
together with the unit?

If the answer is yes, can we also use a antenna with higher gain if we
calculate that it means in decreasing the output power and in our user
documentation have a list of the max allowed transmit output power for
different specified antennas?
