Jim, Look at 15.103 Exempted devices.
I would interpret it that the FCC does not require testing, not that they do not have jurisdiction over such devices. The exemption is only for Part 15 Subpart B, it is possible a device may require FCC approval/compliance under another part. Such as ISM equipment under Part 18. Looking at 15.5, exempted devices are not allowed to cause interference.
