US and States' Legislation indicates EPS manufactured after dates
identified in the associated enacted legislations must meet requirements
to be shipped into same.

As to teeth, shipment will not be allowed if intercepted. Thus your
customer suffers.

Dennis, Don, et al,

So if you have an existing supply that it is non-compliant and there is
not a replacement yet, what are the repercussions?  Will this only be
enforced in federal government tendered contracts and maybe some state
government contracts?  Is this enforced at the retail level?  I see lots
of requirements but I don't see the teeth.

Tricky date of manufacture requirement.

Here is how we are handling the date of manufacture:
As you are aware, an EPS can be shipped in the US as long as the date of
manufacture is before July 1, 2008 for most states. 

Note that:
---California had implemented level III for January 1, 2007 and July 1,
2007 depending on application. So any EPS shipment into California if
not compliant would need to have a date of manufacture before January 1,
2007. Any supply manufactured between January 1, 2007 and July , 2008
would need to meet the level "III" requirements to be shipped into
California after July 1, 2008. Also, level IV had already been enacted
to take effect July 1, 2008.
---Now there are several states that have recently enacted requirements
equivalent to California ECE tier 1 ("III") for EPS manufactured after
January 1, 2008. So, for these states, the EPS if non-compliant would
have a date of manufacture prior to January 1, 2008 or would have to
meet Level "III" requirements for date of manufacture between January 1,
2008 and July 1, 2008 to ship into these states after July 1, 2008. 

Confused yet?

Australia and New Zealand in pending legislation appear to require that
the EPS meet the level "III" requirements when imported on or after
October 1, 2008 this would be regardless of date of manufacture. EPS
imported before this date can be delivered in country.

The date of effectivity is July 1, 2008.  Section 301 which addresses
external single output power supplies does not identify specific
categories of products.

The only exception that I found was for spares produced after 2008.

Effectivity applies to date of manufacture of the power supplies.
Interesting point, does it apply to ps manufacturers or End Use
products?  My take would be End Use, just like having the required
safety mark.  The enforcer (?) would come after the guy who placed it on
the market...just my opinion.

Policed? Don't know, but curious...

Is this requirement for all products in all applications? How about
Industrial or laboratory products?

Is this a requirement for the power supply manufacturers or the End Use
product provider?

The link I provided earlier is to an Excel spreadsheet with multiple
tabs. There is a tab for ac-ac supplies. The list is much shorter than
the ac-dc tab, and the highest nameplate power rating is 36W.

Nothing I say represents the opinion of my employer or my cat, but my
dog concurs.

1. My employer, and some other power supply mfrs, have had hi-eff
component supplies on the market for years, but all the industries that
we sell to (IT, medical, and instrument) just want it now, want the cost
to be just above dirt, and yet want it super-simple (although some of
our custom medical stuff has lots of bells and whistles). And almost no
one wants a leading-edge, uber reliable, hi-eff power supply; so they
remain expensive. You get what you pay for...

2. My employer, and several competitors, are developing small units to
meet the 85% operating eff and the 0.5W off-line mode requirements. Most
power supply mfrs were not, until recently, allowed to commit
engineering resources to design units that conform to energy stds
because, other than several non-federal governments, there was no clear
indication that this legislative edict would be issued, and that it
would effect a large enough scale that would 'force' the creation of a
market for these units. That is, almost none of you wanted to buy hi-eff
stuff until the Peoples Republic forced you too...

I know that this does not answer the OP question. But, I think the
compliance community needs to be aware of the basis of this messy
situation. Also, for the next year or so, there will be confusion on
energy compliance. There are still unanswered questions of the test
metrics involved, and how to specify compliance.

Public Law 110-140, previously known as HR6 is now in effect.

Of significance is that external power supplies are now covered under
federal law for standby and active mode efficiency (Title III Section
301).  Efficiency level IV is required July of this year; the bill was
signed into law in December, providing only a
6 month transition period.  
A number of power supply manufacturers for mid range supplies
(50W) seem to be challenged to meet the standby limit.  
Would anyone care to identify vendors that they have had success with in
providing level IV compliant mid range supplies?
