Hi Jim, You won’t find it in Part 15. Instead, you’ll find in Subpart I—Marketing of Radiofrequency Devices in FCC Part 2. Section 2.803 specifically should address your situation.
Please note that demo, beta or proof of concept equipment by definition (not production quality or a marketable product) likely precludes sale, lease or marketing of that equipment (the FCC even forbids advertising this equipment). Also, note that many EMC legislations such as the EMC Directive (Article 4.3) or other such requirements require a visible means that states that such a product does not comply with the applicable requirements and is not for sale or lease, or other such wording. The hardware is not production hardware. The equipment is not sold; it is on loan and is ultimately returned to the manufacturer. I know that server manufacturers provide loaner preproduction hardware that has no FCC certification to OEMs for testing. Anyone point me to the rules? I can’t find any mention 47CFR Part 15.
