The new Directive comes into force on 29 December 2009 so 
Declarations issued before then are to be made under 98/37/EC and 
after that date will need to reference 2006/42/EC.

The new and old directives are considered to be so similar that there 
is no need for a transition period where both directives co-exist.

The Commission have published a useful FAQ on the transition between 
the two directives which is available from
